This privacy policy sets out how Distinct Designs (London) Ltd uses and protects any information provided through www.DistinctDesings.co.uk (hereinafter also referred to as the “website”).

Distinct Designs (London) Ltd is serious about protecting the privacy of our users. Therefore, Distinct Designs (London) Ltd applies the General Data Protection Regulation (GDPR) (EU) 2016/679 to ensure that their privacy is protected.

Should Distinct Designs (London) Ltd ask you (the user) to provide certain information by which you can be identified when using this website, be assured that it will only be used in accordance with this privacy statement.

SECTION 3 - Data collected through the website DistinctDesigns.co.uk

Distinct Designs may collect and process the following data:

  1. Users may give us information about themselves by filling in forms on DistinctDesigns.co.uk or by corresponding with us by phone, e-mail address or otherwise. This includes information you provide when you register for a Customer Account. This information includes but is not limited to name, email address, postal address, billing address, telephone number, username and password.
  2. Upon each of the User’s visits to DistinctDesigns.co.uk, we may automatically collect technical information, including the Internet Protocol (IP) address used to connect users’ computers to the Internet, your login information, browser type and version, time zone setting, browser plug-in types and versions, operating system and platform;
  3. Distinct Designs may also collect information about users’ visit to DistinctDesigns.co.uk, including the full Uniform Resource Locators (URL) clickstream to, through and from our site (including date and time), page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), and methods used to browse away from the page and any phone number used to call our customer service number.
  4. Distinct Designs website is using Tidio, a chat platform that connects users with the customer support of Distinct Designs (London) Ltd. We are collecting email names/email numbers only with the consent of the users, in order to start the chat. The messages and data exchanged are stored within the Tidio application. For more information, please refer to their Privacy Policy.
    Distinct Designs (London) Ltd. is not making use of these messages or data other than to follow up on users’ registered issues or inquiries. Your personal data will be processed and transmitted in accordance with the General Data Protection Regulation (GDPR).
  5. Distinct Designs does not collect payment card detailsof our users; see Section 8 for more details
  6. Distinct Designs is also working closely with third parties (including, for example, business partners, sub-contractors in technical, payment and delivery services, advertising networks, analytics providers) and may receive information about you from them.

As an example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, then your personal information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act.

Once you leave our store’s website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service.

We process your personal data for the following reasons:

  • When you purchase something from our store, as part of the buying and selling process, we collect the personal information you give us such as your name, address and email address.
  • When you browse our store, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system.
  • When you contact us to ask for help with products or services
  • When we need to inform you about changes to our Products or Services
  • Email marketing (if applicable): With your permission, we may send you emails about our store, new products and other updates.

SECTION 5 – YOUR CONSENT, your choice

How do you get my consent?

When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only.

If we ask for your personal information for a secondary reason, like marketing, we will ask you directly for your expressed consent.

How do I withdraw my consent?

Age of Consent

By using this site, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

SECTION 6 – DATA STORAGE

The data shall only be stored for the time strictly required for each purpose of the processing and shall promptly be deleted straight afterwards, without prejudice to the legal storage obligations provided for by the law. According to that:

  • In case where users purchase Distinct Designs products or subscribe to Distinct Designs Services through the website, the personal data will be kept as long as the contractual relationship between the parties is maintained and, in any case, until legal liabilities are extinguished definitively (by expiry of the statute-of-limitations period).
  • In all other cases, the personal data provided will be kept as long as the data deletion is not requested by the user. Likewise, data will be kept according to the legal time-frame set forth in legal, fiscal and accounting matters, taking as reference the date of the request for data deletion.

SECTION 7 – Legal Basis for Disclosure

The legal basis for the processing are the following:

  • In case where users purchase Distinct Designs products or subscribe to Distinct Designs Services through the website, the legal basis for the processing is the performance of the contract entered into the parties.
  • In all other cases, the legal basis for the processing is the consent provided by the user.

SECTION 8 – Our e-commerce Platform

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

Your data is stored through Shopify’s data storage, databases and the general Shopify application. They store your data on a secure server behind a firewall.

Payment:

If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.

All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover.

PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

SECTION 9 – Data Disclosure

Users personal data may be disclosed to third parties which are companies that provide services to Distinct Designs.

These third parties are:

  • Shopify, which renders trading services regarding Distinct Designs web and software.
  • Other service providers, such as our payment providers and third-party applications which integrate with our Services to perform any contract we enter with them or our users;
  • Advertisers that require the information to select and serve relevant adverts to our users and others; and
  • Analytics providers that assist Distinct Designs in the improvement and optimization of Distinct Designs.co.uk our Services.

Distinct Designs also may disclose your personal information if we are required by law to do so or if you violate our Terms of Service, or when we believe in good faith that disclosure is necessary to protect the safety of our users or the safety of others, investigate fraud, or respond to a government request.

SECTION 10 – YOUR RIGHTS (Rights of the Data Subject)

You have the following rights regarding its personal data:

  1. Right of confirmation: to obtain from the controller the confirmation as to whether personal data concerning you is being processed. If you wish to avail yourself of this right of confirmation, you may at, any time contact our data protection officer or another employee of the controller.
  2. Right of access: to obtain from the controller free information about your personal data stored at any time and a copy of this information.
  3. Right to rectification: to obtain your personal data from the controller without undue delay the rectification of inaccurate data
  4. Right to erasure (Right to be forgotten): to obtain from the controller the erasure of personal data concerning you without undue delay and the controller shall have the obligation to erase personal data without undue delay where one of the following grounds applies and as long as the processing is not necessary:

- The personal data are no longer necessary in relation to the purposes for which they were collected or otherwise processed.
- You withdraw consent on which the processing is based according to point (a) of Article 6 (1) of the GDPR, or point (a) of Article 9 (2) of the GDPR, and where there is no other legal ground for the processing.
- You objects to the processing pursuant to Article 21 (1) of the GDPR and there are no overriding legitimate grounds for the processing, or You object to the processing pursuant to Article 21 (2) of the GDPR.
- The personal data has been unlawfully processed.
- The personal data has to be erased for compliance with a legal obligation in Union or Member State law to which the controller is subject.
- The personal data has been collected in relation to the offer of information society services referred to in Article 8 (1) of the GDPR.

  1. Right of restriction of processing: to obtain from the controller restriction of processing where one of the following applies:

- The accuracy of the personal data is contested by you, for a period enabling the Controller to verify the accuracy of the personal data.
- The processing is unlawful and you opposes the erasure of the personal data and requests instead the restriction of its use instead.
- The controller no longer needs the personal data for the purposes of the processing, but they are required by the data subject for the establishment, exercise or defence of legal claims.
- You objected to processing pursuant to Article 21 (1) of the GDPR pending the verification whether the legitimate grounds of the controller override those of the data subject.

  1. Right to data portability: to receive the personal data concerning the user, which was provided to a controller, in a structured, commonly used and machine-readable format. The user shall have the right to transmit those data to another controller without hindrance from the controller to which the personal data have been provided as long as the processing is based on consent and the processing is carried out by automated means. Furthermore, in exercising his or her right to data portability pursuant to Article 20 (1) of the GDPR, the data subject shall have the right to have the personal data transmitted directly from one controller to another, where technically feasible and does not adversely affect the rights and freedoms of others.
  2. Right to object: to object, on grounds relating to the user’s situation, at any time to processing of personal data concerning the user which is based on point (e) or (f) of Article 6 (1) of the GDPR. This also applies to profiling based on these provisions.
  3. Right to withdraw data protection consent: to withdraw consent to processing of the user personal data at any time.

Finally, you have the right to lodge a complaint to the appropriate Data Supervisory Authority, but we ask that you grant us the right to respond and rectify any requests you made to us first.

SECTION 11 – SECURITY

To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.

If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption.  Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.

SECTION 12 – LINKS

When you click on links on our store, they may direct you away from our site. Once you have used these links and left our site, you should note that we do not have any control over that other website and therefore are not responsible for the privacy practices of other sites and encourage you to read their privacy statements.

 

SECTION 13 – COOKIES

Distinctdesigns.co.uk website has cookies but you have the option to prevent the generation of cookies, by selecting the corresponding option in your browser program.

Here is a list of cookies that we use. We’ve listed them here so you that you can choose if you want to opt-out of cookies or not.

 _session_id, unique token, sessional, Allows Shopify to store information about your session (referrer, landing page, etc).

 _shopify_visit, no data held, Persistent for 30 minutes from the last visit, Used by our website provider’s internal stats tracker to record the number of visits

 _shopify_uniq, no data held, expires midnight (relative to the visitor) of the next day, Counts the number of visits to a store by a single customer.

cart, unique token, persistent for 2 weeks, Stores information about the contents of your cart.

We reserve the right to modify this privacy policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website. If we make material changes to this policy, we will notify you here that it has been updated, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it.

If our store is acquired or merged with another company, your information may be transferred to the new owners so that we may continue to sell products to you.
